CBSN ORIGINALS TACKLES THE COMPLEXITIES OF TITLE IX
Nov. 22, 2019 – While a handful of sexual assault cases on college campuses make headlines, many more go entirely uncovered and unresolved. In 2009, colleges reported more than 3,000 alleged “forcible sex offenses” and in 2013, that number nearly doubled to more than 6,000. While the official number of Title IX investigations in cases of sexual misconduct is unknown, how colleges have tried to address that misconduct has become concerning. Currently, there are 134 active lawsuits against colleges and universities filed by students -- of all genders -- who say they were not only denied due process in sexual assault proceedings, but were futher harmed by the process itself. With so much at stake, many accusers, respondents, and administrators say the system isn’t working.
The newest CBSN Originals documentary, “Title IX,” through first-person accounts from victims, respondents, and attorneys working on both sides, examines the complexity of the law and how sexual assault complaints are handled and litigated by colleges and universities. Title IX was originally enacted in the early 1970s to combat gender discrimination on college campuses, and grew over time to protect against discrimination in sports programs and eventually, in the early 1990s, expanded to prohibit sexual harassment. Brett Sokolow, President, Association of Title IX Administrators, notes that when the courts expanded Title IX to cover sexual harassment they “didn’t give a lot of clarity to what a school should do. So in one school there may be decisions that tend to be victim favoring, at another school there may tend to be a process that is favoring the respondent.”
“Title IX” is the fifth episode in a new six-part CBSN Originals series titled “Speaking Frankly,” which brings viewers into conversations on topics that are often seen as impolite or too controversial to fully discuss, including non-monogamous relationships, child marriage in America, how pornography is warping perspectives on sex and relationships, and the unprecedented challenges of raising children in a rapidly changing world.
